These General Delivery Terms apply to all commercial transactions entered into between and between the electronic portal of Favorit Home Ltd., address: Burgas, Sredets, Dyulevo village 8330 phone: +359 877 921 286 e-mail:
market@favorithome.com , Markets Favorit Home), hereinafter referred to as MERCHANT, on the one hand, and, on the other hand, a natural person and / or a legal entity, hereinafter referred to as a CUSTOMER where the MERCHANT undertakes to sell and deliver and the customer to buy, accept and pay the goods or service he has ordered. By submitting the order via e-mail, the Customer accepts and confirms that the transaction is made under these General Terms and Conditions and they are legally binding on it.
The placing of an order and the acceptance of our written confirmation of the order are considered as the client's agreement with these Terms and Conditions. Different terms requested by the client require us only if we explicitly accept them in the form of a separate written contract.
 
Favorit Home is a representative of the products on the internet store page. The manufacturers are from EU countries (Czech Republic, Bulgaria, Romania, Germany, France, England, etc.) and Serbia and have all the necessary certificates for construction products, health safety and technical passports - a result of laboratory tests. Upon request by the CUSTOMER, Favorit Home is required to provide the certificates translated into Bulgarian by a legalized vendor.
Upon additional request from the CUSTOMER and at an additional cost, Favorit Home may design an architectural detail or technical design for the practical use of the particular product. This will be the subject of a separate contract.

 
1. Offer and delivery

The products on the /market.favorithome.com/ website are not legally binding but are a demonstration online catalog describing the Merchant's product line.

Written orders placed by the customer are considered to be binding on the Market Favorit home when our written confirmation, which is relevant to the subject, volume, delivery time and price, and the same is mandatory confirmed by the CUSTOMER. Orders placed by the customer are binding on after a written confirmation from Market Favorit Home.

Additional arrangements and amendments must be confirmed in writing by us.

Favor Home reserves the right to constructive modifications as well as other modifications to technical data and parameters as long as they serve technical progress.

It is possible that the producers of the goods listed in the catalog do not have the goods ordered by the customer in stock, in which case the production and delivery time may vary between 2 and 5 working weeks.

In the query to Market Favorit, the Customer must indicate exhaustively the type of the product by catalog number, the quantity of product: liters, sq.m., cubic meters. , kg, tones or more. and place of delivery. On receipt of a request, Favorit Home is obliged to notify the CUSTOMER of inventory and if there are none for the term of manufacture and delivery.

Favor Home reserves the right to refuse delivery of a confirmed order in case the goods are not available. In the absence of stock availability of the requested product, within the working week, Favor Home informs the CUSTOMER of the exhaustion by sending a message to the email address specified by the Customer or the designated telephone number. In case a transfer is made to the MERCHANT'S account, the client will be able to choose between refunds, cancellation of the order or a substitute order.

The contract language is Bulgarian and the payments will be made by bank transfer in Bulgarian levs with VAT, for which the Merchant is obliged to issue a tax invoice. In the case provided for in these general conditions, payment may also be made by means of a charge.

In the case of the documentation submitted to Favorit Home and attached to the inquiry and / or the order (drawings, specifications, models, etc.), it remains the property of the client. It is a mandatory basis for developing a bid from Market Favorit Home. When placing an order, if the customer wishes to make a further change compared to the original query and the Market Favorit offer, he must request this amendment in writing, subject to additional payment.

The documentation attached to Favorites (drawings, specifications, materials, samples, tools, models, etc.) remains the property of Market Favorit Home. The Client undertakes not to use this documentation for other purposes, not to reproduce it and not to make it available to third parties.

Obvious mistakes, such as print, arithmetic, spelling, and calculating errors, are not binding on Favorit Home, and there is no reason for the customer to claim damages. In the case of wrong amounts submitted by the CLIENT for calculating the quantitative account, Favorit Home is not responsible.

 
2. Prices, payment and transportation

The prices are valid from the warehouse of each manufacturer - EXW warehouse by manufacturer. The order starts after receiving a 100% advance payment, unless otherwise agreed.

Prices of products in the catalog include value added tax but without transport to the user's address.

The prices are in BGN and are formed at 1EUR = 1,95583 BGN, and in the case of a change in the rate, the price is recalculated.

The expedition and packing costs are borne by the customer if there is no other arrangement for which the latter is informed in advance upon confirmation of the request.

In the query to Market Favorit, the Customer must indicate the quantity of product: liters, sq.m., cubic meters. , kg, tones or more. to calculate the volume of the shipment. Favorit Home actively works with several large forwarding companies and can provide the Client with a cost for groupage transport to a warehouse of forwarding companies in Sofia or to a place specified by the Client.

The price for shipping and delivery is separate and strictly specific for each order.

In case of availability of quantities and / or samples when sending the order from Favorit Home warehouse in Sofia, payment can also be made by cash. All transportation costs are at the expense of the CUSTOMER. In the event that the Merchant is engaged in transportation, he duly informs the Customer in advance of its price, which is not included in the price of the ordered goods.

Immediately after delivery, the goods should be carefully inspected by the CUSTOMER or an authorized person. Any damage, hits and other damages should be reported immediately to Market Favorit Home. In the event that damage is found to have occurred during the shipment of the goods, Favorit Home is not responsible. If there is a high probability of breaking or damaging the merchandise, the CUSTOMER is entitled to require insurance of the shipment, for which Favorit Home is obliged to provide him with additional information on the cost. In the case of a false and / or erroneous address, contact person and / or telephone when submitting the application, Favorit Home is not bound by any obligation to perform the order.

When the goods delivered apparently do not correspond to the goods ordered for purchase by the Customer and this can be established through its regular review,

The customer may wish to have the delivered goods replaced with the corresponding item

3. Term

 
The delivery term is indicated on the order confirmation and begins to run from the date of receipt of a 100% advance payment.
Adherence to the delivery term implies that the Customer has specified the subject of the sale.
The delivery period is extended in case of obstacles that are due to force majeure and / or can not be attributed to the Trader's fault.
If the expedition is delayed at the customer's request, Favorit Home is entitled to dispose of the subject of delivery after a reasonable period of time.
Partial and early deliveries from Market Favorit Home are eligible.
Partial deliveries at the Customer's request are eligible upon payment of the additional transport costs associated with them.

4. Transfer of risk

 
In the case of contracts where the Merchant sends the goods to the consumer, the risk of loss or damage to the goods passes to the consumer at the time when the consumer or a designated third party other than the carrier accepts the goods. The buyer is obliged to notify in writing immediately after receipt of the goods

When the Customer has chosen a carrier and has instructed him to transport the goods and the carrier selected by the consumer is not among the carriers offered by the Merchant, the risk passes to the consumer when the goods are transferred to the carrier selected by him.
Upon customer's request and on his / her own account, Favorit Homes secures insurance against theft, damage, fire, flood and damage caused by transportation as well as against other risks, and the price is agreed in advance and approved by the Customer.

5. Reclamation, Warranty and Right of Withdrawal

In the event of non-compliance of the consumer goods with the sales contract, the Customer has the right to make a claim requesting the Merchant to bring the goods into conformity with the sales contract. In this case, the Customer may choose between repairing the goods or replacing them with a new one unless this is impossible or the remedy chosen by him is disproportionate to the other.

The bringing of a good in accordance with the contract of sale is free of charge for the consumer and is carried out in accordance with the rules of Art.

The Customer makes the claim to the Merchant by explicitly indicating the subject matter of the claim, the preferred way of claiming the claim, the amount of the claim claimed, and the contact address.

When making a claim, the user must also attach the documents on which the claim is based:

1. receipt or invoice;

2. protocols, acts or other documents establishing the non-conformity of the goods or the service with the agreed;

3. other documents establishing the claim on grounds and size.

 
The commercial guarantee does not affect the rights of the Client arising from the guarantee under Art. 112-115

Upon a reasonable claim, we bear the cost of replacing advertised items. The client must provide us with the necessary time and opportunity to make the replacement.

The Customer has the right to change the terms or reduce the price only when the repair, replacement or removal of the defect has not occurred in time after the reminder or has failed definitively after multiple attempts, despite reasonable time.

Other claims of the Customer are excluded, and in particular claims for damages for damages where they are not related to the subject matter of delivery itself.

Upon a reasonable claim, the replacement period for advertised products is within 30 business days.

Favor Home does not generally assume any damages for the following reasons:

Inappropriate or inappropriate use, non-observance of the operating and installation instructions, misappropriation on the part of the Customer or third parties, arbitrary attempts to commission or change, natural wear, improper or negligent treatment, chemical influence, electrical influence, etc., as well as for non-intended use and non-observance of our recommendations for operation and installation.

Our data on the subject of delivery and its purpose, e.g. in terms of weight, hardness, operating values, temperatures, etc. are only descriptions or descriptions. parameters, not guaranteed properties. They are non-binding values ​​and are considered to be warranted in so far as they meet the manufacturer's samples tested by them and the certificates of their special purpose. Minor misalignments do not warrant warranty claims.
The consumer has the right to withdraw from the contract, observing the term under Art.50 of the CPA and the procedure under Art. 52 et seq. Of the CPA, in case the prerequisites of Article 57 of the CPA are not met.

6. Impossibility, delay, responsibility

If there is a delay in delivery on our part and the Customer gives us an additional reasonable time with the express statement that after the expiration of this period he will give up delivery, he shall have the right of withdrawal if this additional period is not observed. If this additional period is observed by us, but the Customer's fault is delayed acceptance of the delivery, then it is bound to have no claims.
Any other claims of the Customer are excluded and in particular for losses incurred as a result of lost profits and also such damages not related to the subject of delivery.
In case of force majeure, in so far as it changes the economic significance or content of the volume of the supply or has an impact on our work and if there is a further inability to fulfill it, then the contract changes accordingly. If this is unprofitable, Favorit Home has the right to withdraw from the contract in whole or in part.

 
7. Confidentiality
 
Customer is obliged to treat strictly confidentially any information, know-how and other business secrets in connection with the execution of the respective order and not to give or grant third parties access to information, documents, drawings, sketches or other materials without the explicit consent on Market Favorit Home. Favorit Home will also refer to client documents as confidential.
